I just received a letter from the person who took my AOS interview
The letter reads like this,
The Priority date for your classification is not current at this time. Your case meets the requirements for abeyance until a visa number is available for your priority date. Please refrain from making status inquiries until 90 days after your priority date is available. To view priority dates go to: http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html
wow...she screwed us royally..on face she said she is going to approve our petition as it every thing and also PD is CURRENT..Now she sent a letter saying my PD is not current and adding insult to an injury she sent a link to the DOS bulletin which says I am current.

In my opinion keeping donation options from $25/- upwards to whatever max value within One time and recurring categories would be inclusive startegy.
Currently we are turning away the members who want to donate but who can not afford and/or do not want to donate $ 100/- and upwards.
My personal theory is that who is really willing to donate $ 100/- and upwards and can afford is going to donate that handsome amount even if we keep $ 25/- option.
Now Ball is in court of core.
I beg to differ. IV is not turning away anyone. What stops someone from contributing $100 once every 10 months?
The issue is something else.
In order to contribute even $10, you need to:
1) be convinced about the cause of IV
2) be convinced this organization means business!
3) give up the "penny wise pound foolish" attitude
(1) This should be easy for those who were unable to file their AOS applications in July/August 2007, because one of IV's primary goals (abolish retrogression) should then be your goal.
This is also easy for those who filed their AOS, if only they realize that "working on AC21/EAD" is not as much fun as it seems, you really need the Green Card to live and work the way you want!
(2) is a proven fact, and most of us are already enjoying the benefits of this!
(3) Finally, people feel overwhelmed by the thought of donating $50 or $100 to IV but they are happy to spend much more on gasoline, phone-calls, and drinks. You make no difference to your quality of life when you spend $50 on gas and $100 on food when you go sight seeing on a weekend. But when you donate that money to IV, you are supporting the one and only grass roots organization that means business when it comes to fighting for your own quality of life!
It's like investing in a "credit score" monitoring product for a year before you actually apply for a loan!
If that analogy makes sense, please please realize you need a similar strategy for your green card, and contribute to IV.
Preferably, sign up for recurring contributions, as this is the one thing that will help IV in forecasting and planning.
If nothing else, write to a core team member and let them know you will pay $N1 over N2 number of months.

Looks like this campaign is loosing the steam..... My $500 have been waiting for two days now..... We started with 33% capital and not even at 50% ...this forum cannnot even run for 17%..... forget the next 50% we need to cover by 31st December.... Looks like I saved some money.

Hi all,
I have been following this thread and some posts suggest that the Observation on the passport for correcting the name is sufficient. Here is my situation:
My passport had the name as:
Surname: A***********
Given name: P****
The correct name should be (since this is how I use it in the US now and it applies to all my docs here - GC, DL, school records, everywhere).
Surname: P****
Given name: A***********
I got this corrected in the Indian passport through an "Observation" on Page 3 which states:
The name of the passport holder appearing on Page 1 has been corrected to read as:
Surname: P****
Given name: A***********
Since this is not a "name change" as such but simply a re-alignment of the last and first names (often a source of confusion from India), I hope this is sufficient and I don't have to go through a name change to get a new passport book issued.
Any comments would be greatly appreciated.

On the same note I have a question for the Gurus.
My name is reversed ( first name and last name interchanged) on my SSN and hence on my credit cards, employment letters etc though my name is correct on my passport , H1 , I-797 and on files AOS.. etc.
Will this pose a problem in the name check process?
My attorney said I should change my name with SSN after EAD/AP arrives.
Let me know ur opinions.

If my wife who is an MBA finance from Mumbai, currently working as a corporate banker with one of the top 5 banks in the world comes to the US on an H4 & decides to do a CPA certification, can she work on OPT until the H1B quota opens up next year???
It will be ok as long as they give her an F1. Here is something from a website -
Eligibility for OPT
OPT must be in the field of your declared or intended major. The relation can sometimes be fairly loose; for example, a math major would often be relevant to a business job involving statistics, analysis of data, financial figures, etc. The determination is up to your employer, but they are well advised to be cautious. In case of doubt, it might be good for them to insert a mention in your offer letter subtly mentioning your major as being relevant to the job.
Your employment must be commensurate with your educational level; for example, cooking fast food would not be commensurate with a completed Business major.
You must have been in F-1 status at some point for at least 9 continuous months as a full-time student, not including high school. These 9 months can include summer vacation; one summer plus one semester might or not be enough. These 9 months can include time as a student in J-1, J-2, or other appropriate status.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. I am of the same opinion. We must make presentations to the Foreign Affairs Dept, Justice Department, Presidential Nominees and the Current President and seek from other larger Indo-American, Indo-Chinese Organizations to highlight our suffering. It does not matter whether we are EB2 or EB3 from India or China. What matters is that this is great injustice. How many members of these departments would accept living like us in a country like USA? Are they ok with living in the uncertainty like we do? Will they accept being in the same pay bracket or at the same job level for 5 or more years and that too is not certain? Can they keep their life on hold particularly in the prime of their youth, the way we do? We must remind them how many documents and how many verifications we have to go through to get to the GC (right from F1 or H1 stage). On top of that when the depts life USCIS which are created to facilitate Immigration, turn their backs on us, what does the US Govt expect from us? What does the US Govt expect us to do when DOS second guesses everything that USCIS does and readjudicates and harasses visa applicants through the consulates (with unending and unaccounted for visa stamping delays)?
I have created a spreadsheet with visa bulletin data for the last one year. Anybody with some sense of justice and fairplay can easily look at the data and say that there is no order and no justice for our plight. I created trend charts for EB1, EB2, EB3 and ROW but these did not get uploaded properly. If somebody wishes to try again and recreate these and some how publish them, these charts could be used to communicate our plight in a very simple manner.

By linking the process to sponsoring employer they are promoting indentured labor and by forcing us to file new LCAs/ restart GC process for each promotion, they are just being anti-immigrant and anti-progress.

Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even though they are few...the impact is big... With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. The 3000 - 5000 is just a conservative realistic guess.. not based on any data. Do the Math !!! You might agree !!!

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item
