My wife has the same problem and problem became apparent when she was in India in March to get H1 Visa stam. 3 years back when she got her first visa stamp, we had used Last name first name format in the application form. However this time the Embassy did not accept it, in the visa issued they stamped FNU (Family name Unknown) in the section marked Given name !!! and mentioned her Firstname, lastname in section marked Surname (Exact opposite to what is in her passport !!!!). When my wife pointed this out to embassy officials, they said it is the SOP in this situation and adviced her to correct the Passport.
As I understand, correcting the name in Passport should'nt take much time. Is'nt it same day service?

My company has applied for H1-B visa for me under the master's quota and premium processing. On the lawyer's website I can see that my application was filed on 3/30 and probably received on or around April 2nd by USCIS.
However, I have not yet received a receipt notice for my application. I am aware that the premium processing deadline is fast approaching and I am getting a little concerned. Is there anybody else out there in a similar situation who has not yet received their receipt notification?
Can anyone advise me on my options? Is there a possibility that the application could have been lost in the mail or something else? Can I re-apply since the master's quota has not yet been filled?

I joined IV only this month due to the July visa fiasco. I learned a lot from all the members and the IV core team. I haven't made any contribution so far. My husband who has a H4 visa just recently graduated from nursing school and finances are tight. Anyway, with this new development, hopefully my husband will be able to get a job with his EAD. We will be in a position to contribute to IV. Thank you again!!!

Looks like this idea has come out of mere frustration. Do you know how many people want to immigrate to the USA? Do you know how many people are waiting in line? Do you think it is correct that only EB-immigrants should be given preference? Why because USA needs all of them? While I have used "you" in the previous sentences, I don't mean just you....rather "we".
If you have time-bound path to immigration, then right now, the whole Federal Govt. and all employees will have to work only on getting the immigration files cleared. Under current circumstances, I think the current system will get you a GC faster than if they switched to "time bound" today. Do you realize, how many people will suddenly be suing the Govt. for delays? There is no country which guarantees time-bound path to PR.
While I forcefully oppose the DREAM ACT and CIR, these did not give time bound GCs but only allowed illegals to convert to legals and in time APPLY for GC if they become eligible.

I honestly do not understand why you seem to be opposed to this approach to alleviate the sufferings of so mant EB3 (esp) and EB2 friends. Discussion and debate are always good.
Here are a few facts:
1. Most of the advanced countries in the world - UK, Australia, NZ, Switzerland, Singapore and some Scandinavian countries offer a time based path to residency and citizenship for the educated class of people who come through the proper channel to work
2. In Canada, Australia, NZ (there could be other countries, but I am not sure) people can apply for a PR based on their OWN education and experience. They are not held hostage by their employers and harassed for ages. It is happening here because the lobbies are very powerful and are supported financially by the corporations to serve their interests. The system has been craftily designed to ensure long term indentured labour
3. In the entire scheme of things the real beneficiaries are the employers and the law firms
4. The system would be streamlined and the work of the government would become much simpler and faster. This is the way governments works in several western countries who offer a time bound programme
5. Every month our EB friends need not stare at the bulletin with great expectations and waste their time
6.Everyone can plan their future better. (I do not think I need to explain this)

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

My GC process was started in 2001, my labor was approved in 2003 but since my company was closing the branch office where I worked, I had to move to the main office which was in a different state. Due to this my approved labor went down the drain. I moved to the state of the head office, meanwhile my company off-shored a major portion of the development office where I was working early 2005. After much persuasion from me the filed again but I had to either move offshore or take up a 90% travel job with the same company. Now, I travel and am away from my family during the weekdays. I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?
With the retrogression my GC could take years....sometimes I wonder if the stress, living in constant fear not knowing what is going to happen tomorrow, staying far away from loved ones, all these sacrifices is really worth it when legal workers like me who have contributed to the economy of America seem to have no value in this country.

Potatoes, maybe.
But seriously growing your own vegetables is a fun activity. I have not done groceries in the last few months (exceptions being junk fast food, yoghurt etc). We grow vegetables all year round. In fact we have excess of most vegetables we grow. Try it, its a lot of fun!
And good luck to all EB2 and EB3 folks - we've seen good EB2 movement and we hope we'll see more movements in both EB2 and EB3 in the days to come. Till then, Happy gardening!!

I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.

If HR 5882 bill is passed, it is good that we have more visa numbers. But the issue of random processing without considering priority dates is frustrating to people with older PDs. Lot of people here are eligible to get GCs with the current cutoff dates, but still are being left out. I think, this is another very important issue to be fight for by the IV core team and members.
