This is just my guess:
It doesnt mean we dont see approvals.
They may have counted all the cases assigned to IO's? or to be assigned cases too? You may still see approvals, it is just that, if your case is not picked up by an IO, you will have to wait till october 1st.
My case is not assigned to IO as of august 8th.

Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

I know I should be asking my lawyer this but what if i94 has been expired from past 3 monthsi.e., from april 2007 , the person has applied for seventh year extension of h1b visa in feb 2007 but it has not come through yet, and they have already done concurrent filing of 140 and 485 in July.
In this situation what does the person (with h4 dependent in the same situation) do ?
Is this a solution:
Make h1 premium now and get the 797 approval, wait for 485 receipt and then go to Canada for getting h1 visa stamping and new I94 card ?
Please advise. Appreciate any suggestions you can give with your limited time :)

Most of todays GC process results in indentured servitude which is against the law. Just that the indentured servitude is implicit instead of explicit but its still there. Can we use this point along with these stories.
Well, if we feel that the GC process results in "Indentured servitude� may be we should head back to a land where we are treated like first class citizens and not complain about work ethics here. We are here because WE WANT TO BE HERE so may be this is the name of the game.
We need to focus on highlighting the difficulties that people face on way to becoming LPR's rather than act like we are handcuffed and gagged by employers.

That memo could be correct but the EB2 approvals that are happening now are the based on the visa numbers left over by ROW in EB2 and EB1

sent june 29th according to lawyer would have been received on june 30th. So not sure if its june 30th or july 2nd.

That is incorrect for my local ASC. I know that for sure. When I went to ASC for FP I do not think they were capable of answering any case related questions. All they do there is take FP notice , stamp it and do FP. They ask you to goto local office for any questions related to your case.
Secondly how come the IO had the authority to show an internal memo to a customer. Does it make sense?
Many are saying there won't be any IO at ASC. Not true, when I went in for Finger prints, I asked the lady who takes the finger prints about enquiring about my I-485 status! She said, she can't help, as she does not have the access and told me to call the 1-800 number and also try asking the IO at the window as there are not many people waiting and is the IO is free she might help.
SO, after finger prints, I went back into the office and there was only one guy talking to the IO another lady was waiting. I asked the lady, if she was waiting for the IO, she said she is here with her husband. She's an African American lady and her husbandwas inside the Fingerprinting room, I am guessing this as that guy sounded like from Africa and may he's a Family Based visa applicant.
Aftert the guy at the counter finished his work, I went to the counter as no one else was waiting there. I asked IO, a nice lady, if she could help me with the Status of our Name Check. SHe asked me, if I had an appointment, I said no, but I had a finger print appointment and I could not get an Infopass appointment around the same time (I had finger print appointment at 3 PM and I did try to get an Inforpass appointment around that time so that I could enquire about the status too, but there was none around that time and the closest one was around 12:45 PM, so I thought I would just try my luck).
She then said, we just received this memo and let me read it and said this supersedes everything and even everything is clear for you nothing will happen, asking me if I was from India/China hesitantly as she could fingure out I was from India, untill new visas are allocated in October. She then took our I-485 receipts and went inside to check the status of our applications.
I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California.
I had talked to her earlier also, after taking an Infopass appointment, as I had receive someone else's EAD and went to return so that the actual person would get her EAD. Last year USICS had sent some one else's EAD to me, the EAD was some one else's, but the letter it comes with was in my name (I had also received my EAD separately, strange are the ways USCIS works and I don't have to tell the guys at IV). Then also, she check status of our applications and told out namechecks were not cleared and finger prints were cleared. SHe even told, even if my wife's checks are cleared they would not apporve her untill my applications is approved. SO, I had this hope that this lady might help this time without Infopass appointment.

USCIS do have some checks and balances for the subst labor cases, so its not a staright approvals for the lab subst cases. their might be a possibility few lucky ones get off the hook, but overall USCIS can weed out the dubious/fraudulent employer petitions.
Sub labor is not the only reason guys, its just the country cap which is limiting india EB-3 and EB-2. Most of the H1Bs like us coming to us ends up applying for GC, now look at the number of H1Bs coming each year from india and the total number of GCs available for india. Their is a huge gap in these numbers, so unless they remove the country cap or recaptured unused VISA numbers from the past years, we dont see any relief.
Please donate to IV and help lobbying for the admin fixes or the laws which going to help us in the long run.

When taking an Infopass appointment, is it ok to choose the option of
Step 1. Case pending
Step 2. If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment
Did anyone use this, even if there was no Service Request filed? Were you asked for a Service Request number? If not, what option does one use to take an appointment?

Hello,
In all my school and college degree certifiectes I have the name
Mr. Firstname Lastname.
When I applied for passport in 1999, my name became
Surname= Lastname
Given Name= Mister Firstname
At that I could not be able to correct it because of govt office harassement and corruption. It's very difficult to do anything in my local hometown passport office.
Anyway, I came to US before 5 years and I got my visa as
Mister Firstname Lastname.
So, my name automattically changed to "Mister Lastname". Intially I didnot even respond if someone called me by "Mister" :)))
My SSN,Diver Lisence etc..has my name as "Mister Lastname". This really frastrates me.
Anyone with the same problem.
Can I correct my name in NYC consulate?
I beleive I have to chnage my name in SSN, Driver lisence...Oh...too many hassle...please let me know how to do that too...
