I am no expert but here is what I think.
by concentrating energy on spilled over milk, why not work towards recapturing unused visa numbers? It has been done in past successfully. It is in huge numbers, guess around 300-400K or so.
while wasting energy on 2-3K or may be 5K lc sub cases will do no good for everyone. visa recapture will solve problems for most of the community.
take your pick. its no brainer!!!
LC Sub is long gone. Those who *legally* got pre-2001 may already have gc by now, and its not going to affect them anyway.
Think in a professional manner and do what provides the most benefit.

1. documented / undocumented is a matter of immigration status..... no human can be illegal..... an activity can be illegal which makes a person undocumented...... as defined by human law...... but above human law there is another law..... which is defined by an entity more or less we all believe in..... how can a new born child.... a creation of the creator be illegal? delivery of a child is not just a matter of mother.... its a matter of another life being brought into this world..... how can that child be illegal?
2. even felons are not shackled to bed.... unless someone is danger to others..... how can a pregnant woman just about to deliver a child be danger to anyone else.....
3. i lost my wallet few days back.... anyone could lose their wallet sometime or the other ..... it happens..... and during that time we are all driving with a license..... does it mean we all must be shackled to bed when delivering a child......

I applied through a consultant for the masters quota and got a reject (I applied on the 4th of april) they have considered it as regular because the package did not contain a course completion letter (i will be graduating this may 4th, so all i could get was just unofficial transcripts.) Now the school agreed to give me a course completion letter.

I will be applying through CmpB tomorrow through masters quota (just got the offer as of today).

what makes you think that EB3 are just graduates only? i worked in top 3 telecom company with B.tech+ 8 years experience before joining that company as full time employee in 2000 Jan. they started by GC process in JAn 2001.
but they have a company policy that all will be filed as EB3 no matter what. i have my colleagues who have masters from US, but still EB3. what do you say ?
what pisses me off is today i have more than 15 years of experience in IT , (yes Information technology only) and still in the line with EB3.
I'm happy that atleast EB2 is moving but at the same time there must be a balance for EB3 as well. that's all my point

Yes, you may end up blocking strive act, but what will happen then is all your jobs are going to start disappearing to eastern europe, China, India and any other place possible. I don't know if you work in high skilled labor market but if you do, I am sure you must have noticed the large number of engineers, doctors, architects who are immigrants and contributing to this society. Anyway, I think discussing this point with you is pointless.

I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.
And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.

This is a good idea. But tough to sell unless basic policy is changed. In USA any immigration has limit in numbers except a few category like spouses of US citizens. It is difficult to change that. When you put 8 years that means unlimited green cards. If they do that universities like TVU will be running full capacity and new universities will be started similar to that. Actually there should be some system to clean up univerity admission and also H1B so that genuine persons can come here easily.
Anyhow it is good idea to bring a bill like this and and see what happens. Still bills like recapture or modest rise of GC numbers will have a better chance of passing in congress

I'm curious if the POE officers know if a person has been laid off? A friend of mine is planning to travel to Canada for the first time. He has an H1b for the past 6 years and approved I-140 and extension. He was laid off for 5 months from Company A but has an approved extension for Company B. This was 4 years ago.. His been working for company B eversince w/o problems.

hi can somebody please tell me that after doing DDS/DMD(doctorate of dental surgery) can we apply under H1B master quota
If she works for a hospital which can do a H1B for her then 'Yes', but if she wabts to start up of her own, she can not petition for herself. I haven't seen any hospitals having dentists on their payrolls. Mostly it is the ER staff like cardiologists, anestheologists, surgeons.

Didnt USCIS issue a Memo or something stating only one h1B filing per person?
I believe this time around USCIS is planning to pick the lottery based on passport number. So, even if you have multiple applications from different companies, you will have to choose one among them.
