They need to enter data into their system before they reject.
Next time when you apply you have to check the box telling that you applied before which they will validate based on the data in their system.

akred, Thank you for helping to promote this petition. I think that when we have enough signatures we must also release this letter in parallel to media outlets while we send it to CNN execs. This will make the folks at CNN more answerable to this petition. However in order to do this we require the backing of IV core and utilize their contacts with the media. An individual like you and me can only go so far. Backing of IV core will provide us with maximum traction to evince response from CNN.

Did it occur to anyone that we are only talking about compensating Aman the $64k he spent already. Imagine if he had made use of that $64k as an investment(let us say a safe investment with minimum returns) of that amount it should have exceeded that $64k value by now.
The least we can do at this moment is to immediately refund Aman and other core team members the amount they have spent towards the administrative costs of IV. Pappu / Logic Life / Other core team members, please let us know what kind of legal/administrative action is required to get this done.
We will immediately start a funding drive towards filling in this shortage from the total IV funds. IMHO on the longer run the smaller funds ($10, $20 etc) should not be neglected.
Let us figure out the required amount and have a new thread started about this. This settlement should be treated with high priority before any other funding drive. Pledging my $200 towards this.

Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. The kind of work and effort that is needed to push a single provision is phenomenal and needs lot of capital. The more the better. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. This website is simply a tool for us to communicate to everyone. The big effort is the lobbying work. You are right, it is very hard to digest, even for you, who seems to support it. And, if I may add, your example it too "complicated" for me. Try giving easy example for me, I am kind a slow, maybe I should get some "preferential treatment". Yes, that's the word, "preferential".
Country quota is NOT affirmative action, nowhere even close. If you are socio-politically dominated by Indian or Chinese, yes, then it is affirmative action. But if you do not come from a place there Indian and Chinese imperial powers have taken over the country, then how are you socio-politically dominated by Indian or Chinese. And if you are not dominated by Indian or Chinese in the country where you came from, then how could it be "like" affarmative action.
Maybe you yet don't know, but Indian and Chinese EB applications cannot vote and they do not have any representation in the US government. So its not that you are "not properly represented" and Indian and Chinese have all the representation. WE ALL HAVE NO REPRESENTATION. Just so that its clear.

For PMP I think, you need to take some courses, I had taken some courses at Berkeley Online on project management, these courses count towards PMP.
They also have in class courses, if you are interested.
Better to do something than nothing.

If we can understand why most of us want a GC we can understand the poll better.
In my opinion most of us here want the GC because we want to change jobs for better pay, better professional growth, to live in a better place, better work environment, etc, the list can be endless. ( I guess if you don't have all these then you don't have freedom)
If we can get our GC's no matter with which employer we work as long as we do our job ( as mentioned in our LC) we will not be bothered too much about our GC process ( We are dependent on our employer sponsoriing our GC so we are not independent)
I can say atleast half of us who are waiting for the GC don't have any ambitions as of now to take active role in building this society, if we really had such we can do that at our home countries too.
Like someone said in this thread " Reverse Brain Drain " is an empty slogan if we use ourselves call ourselves the brain which America needs to keep it going.

My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.
What are our options?
Request an extension for RFE?
Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)

Please check the website of the US consulate of the particular region of India where you reside, like delhi or chennai etc, and or call their information line. They would have local hospitals or Medical examination certification centers that are designated by the consulates as being eligible for providing medical certificates, especially for people with Consular Processing interviews. I guess, that could probably help. Consult your lawyer or take an infopass to verify this information accuracy. Thanks. Sree

We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).

If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

there are many folks whose entire GC process (apps, EAD/AP for the entire family) is funded by the employer. If such folks cringe on the thought of contributing to IV on a regular basis, then there is something wrong with us. :)

USA depends on H1B visa and all types of visas. Not us. We have options and we can live in home country if we do not have options here. Without these visas USA will not survive.
Just think if CHINA boycotts exports to USA what will happen here? People cannot eat GUNS and live with GUNS. Computers will not help produce Eatables. Only people can grow vegetables and produce in lands. For that Americans are not ready to go to Farm and Work. So you need Z and all types of VISAs. Of course people choose USA since DOLLAR Is more when converted to home currency. Otherwise what is the use of coming here?
We are not Beggars. These people here are beggars who are dependent on foreign labor.

A country is not considered advanced by the cell phone models people use, but rather than how much food they produce, what is the standard of living, how many noble laureates it produces per year, etc.
Besides, in my 7-8 years living in this country, first as a student and then as H1 worker, never once have I felt being treated differently because I am a foreigner or look different.
Now compare that to living in Europe (you will be treated as dirt as soon as you enter airport), it is racist, living in past and full of bureaucracy.
As for India, mera bharat mahan, but I remember a time when I had to pay bribe on the train ticket counter to get a measly 2nd class sleeper ticket, or just to get a electric connection, would dare not get near a policeman, etc. etc.. The list is long and I suppose I everyone here knows what I am talking about.
So please ask for your rights but remember you are in their country, nobody forced you to come here, and beggars can't be choosers.
