Do what you got to do and let others do what they think is right. I don't think there is one Success mantra here...because we are yet to be successful.
Honestly, I agree with you...but the underlying fact is some people get motivated for calling the senators and some for anonymous fax/email/flowers and some for rallies. There is definitely a subset who does all...but unless you are a Gandhi/MLK/JFK/Mandela....it's hard to drive people in one route.

in a group this large you simply have to help the commom action and agenda for success. each opinion is important but at the end of the day the common action must be done by all, as far as possible.

We received the RFE for the Td vaccine that was missed somehow by Concentra. But since she is nursing now, we were able to get a blanket Waiver for her.

My situation: My wife still hasn't weaned off nursing completely.
My child is 1 year 3 months old. My wife got an RFE for TB test.
Plus she is in India currently.
Would sending the birth certificate of child be enough to prove the existence of 1 yr 3 month old child? OR would USCIS requires doctors's input also? OR do they require anything else to prove baby is still being nursed.?

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
One more suggestion:
1. Start withdrawing cash from bank accounts and leave the cash with someone whom you trust.
2. US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
3. Keep liquid cash on hand (not even in bank's safe deposit box)
Just thinking out loud.

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment?.
I wouldn�t say ROW is receiving preferential treatment, but they are in an advantageous position due to their representation. I don�t think there will ever be a consensus on the quota issue, both ROW and India/China applicants come up with their own arguments supporting their stand on it.
Personally I think recapturing unused visas will decrease the wait time for India/China applicants without affecting ROW applicants. There won�t be any need to remove quota limits.
And I agree with rajeshalex that this thread needs to be closed. the counter arguments are getting more confusing...

Here is what I have understood from my lawyers -
DOL decree, if adopted, will prevent any further labor substitution.
Any labor approved after the decree is adopted cannot be used for substitution.
Any 140 application based on labor sub will not be denied until USCIS adopts a similar resolution - it is unlikely that USCIS will do such a thing as it will lead to lawsuits from lawyers and folks already in the queue
People with already approved 140 do not need to worry at all.
I am laying down the facts here such that people can make educated decisions on what they want to do.

Hi,I had my H1 revalidation visa approved on Dec 18th at chennai consulate but I have not received my passports till today (more than 7 working days).
It seems PIMS check is happening only at chennai consulate in india.At mumbai consulate one of friend got passports on the same ay.

Nobody know how many cases pending with USCIS...Nobody knows
how much would be PD based distribution...Nobody knows how many
people got LC but who cant apply for I485 because of retrogression..
We always thought that there is 360k application in BEC and since those LC have PD from 2000 to 2005 there are no chances of fast movement of PD in year 2007 especially for EB3 and EB2(Indian , China).
After reading this news it seems employer withdrew many cases, which they filled for employee who no longer work for company, so certified case is going to be only 100k, much lesser then 360 k. How many more years it will take to clear these 100k LC? I don't think it should take more then 2 years...
But you know logic doesn�t work with US immigration system and we also don�t know how many people are applying through EB1 and EB2-ROW, which are current, we also don't know how many people are already sitting in 485 stage�

UN probably didn't realize that the officer id. was different. The id. being different is a good thing, it makes the likelihood of the IO not having noticed the old NOID higher.

Maybe I am being naive. But we are not a political organization. I sure do hope we are not. We should be open, clear and precise about our goals and our funding sources/drives. Frankly our opponents pump in millions of dollars into their effort. Maybe one of these days we can compete with them monetarily. But all I know is they can get millions of dollars but not 25000 committed members.
Also please consider that charging people for reading posts et al or instituting monthly payments will drive people away. People who cannot pay will not pay. All we lose is participation which is more important. You will agree that we want more participation not less.
Hence IMHO we disclose our goals. We disclose our costs up front. We have nothing to hide.

While many of the critics’ attacks have centered on so-called “outsourcing” companies, the intent is to impose new restrictions on all companies that seek access to skilled foreign-born talent. As discussed later in this analysis, many of the restrictions put forward by Senators Richard Durbin (D-IL), Charles Grassley (R-IA), Bernard Sanders (I-VT) and Claire McCaskill (D-MO) would impact all U.S. companies hiring foreign-born talent.
Senator Grassley has said there is a "high amount of fraud and abuse" involving H-1B visas. However, an examination of objective data belies this statement. When questioned by the Wall Street Journal a Grassley spokeswoman cited only anecdotal evidence, saying, “People have called our office.” By objective measurements there is not evidence of significant abuse but modest problems that are addressed through agency enforcement.
The data show it would be mistake to tar all companies with the faults of literally a few. Of the $4.8 million owed in back wages in 2004, more than half (53 percent) came from findings against just 7 companies, none of whom are household names. Abuse does occur but the evidence indicates it is limited and of a character that can be handled within existing laws and regulations.
In fact, the amount of back wages owed to H-1B workers, small as it is, actually fell between FY 2005 and FY 2006. Moreover, the aggregate total of back wages owed is almost infinitesimal placed in the context of a $13 trillion economy. In FY 2005, only $5.2 million in back wages were owed to H-1B professionals based on DOL investigations and the total dropped to $4.6 million in FY 2006. Consistent with other years, 86 percent of the cases investigated (104 of 121) in FY 2005 resulted in no civil monetary penalties being assessed. In FY 2006, no civil monetary penalties were assessed in 89 percent of the cases completed (14 of 133).
The data show the vast majority of cases investigated by the Department of Labor have involved only paperwork violations, not willful abuse, and that back wage payments were generally fairly small. The proportion of H-1B professionals owed back wages is also small. Back wages were owed to less than 1 percent (0.28 percent) of the individuals who received H-1B status between FY 1999 and FY 2002 – a total of 1,323 individuals out of approximately 473,000 individuals.

I got similar reply from ombudsman but still there is no progress in my case.

Check my earlier post. , I was able to talk to IO at TSC, and he had my file assigned to him the same day. There was a problem , in there system , anf my I-140 was showing
