How about we start donating services for the IV. I am ready to donate my time and use my energies to generate money for the IV. Ideas can be

    1. Shampoo your car ($20)
    2 Wash your car ($25)
3 Donate personal DVD's to be rented out to fellow Desis ($2)
4 Dinner and a Movie organized by state chapters. ($100)
    5 Collect Cans to recycle
    6 More Ideas

Hey, dude, I hope that this was a joke :D

Because I doubt that anyone willing to wash my car for a few bucks is highly skilled. Personally, I prefer, give 1 day of salary - that's way over $25, and far more effective (I get paid more than $25 for the time it takes to wash a car).

    [edited]
Huum, I rather thing that it was not a joke. No offense intended.
The dinner and movie is the best idea.
Actually I think that the other ideas to be "less than optimal", thus I thought they were a joke.

Nice. It appears that according to the link below:

    http://immigration-information.com/forums/showpost.php?p=18946&postcount=28

The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.

On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

    Thoughts?

    Did I understand wrong?

After 6 yrs on H1 with pending AOS, if 485 gets denied, H1 is not renewd. So far so good....
I am under impression that aftet the denial, person still has whatever time left on his H1 to stay and work till H1 expires. No futher extension will be possible due to denial.

    Is above statement wrong????

I had checked with my attorney, he had mentioned that I could keep on working till my H1 expired.... I will recheck with him.

    Regards.

That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

    Cheers

Why are you consuming and wasting couple of visa numbers. Pull back your application and I will be couple of hours early getting it.

GC should be received by people who need it desparately not to people like you who just want to get it for personal satisfaction and has no value for it.

Nope. You are misunderstanding the point again.
The Article clarifies that that Congress has the power to regulate immigration. they used the power and created the INS laws we have today, which as per Congress is the hallmark of US immigration. We have to change those laws specific to EB.
You are muddling immigration laws with civil rights. Your argument about the current law being in violation of ANY constitutional right is completely baseless. You did not respond to my question about how the civil rights clauses you quoted have anything to do with immigration.

They used the power. No problem. But how?

Let me quote an extreme example.

If they make a law saying, a foreign woman may be raped at port of entry in exchange for citizenship, will it stand?

NOW do you see the connection between immigration and civil rights?

    How true
Your comment reminded me of something I had penned down right after Prime Minister Manmohan Singh visit to the US. It was very depressing.
    A White Collar Slave
Prime Minister Manmohan Singhs visit to the White House was well reported in the media and the Presidents acknowledgement of the contributions made by the people of India- Indian Americans was most gracious. He also made a point to acknowledge the contributions made by Indian students to Americas Universities. All this is most heart-warming. However, as a legal non-permanent resident awaiting labor certification (or the ability to work) since the past 3 years I feel bound by invisible chains whose cold steel refuses to be warmed. The labor certification process is technically supposed to take 12 months.
Post 9-11, grinding to a near halt the labor certification process of permanent residency applicants is a win-win opportunity for the government. Get these highly skilled laborers on a short-term lease of an H1B. Pass off the bureaucracy and red tape of the INS on the process of Homeland security. The latest breakdown, the INS information technology system has been down for 6 weeks now. When asked questions about a status of the system, they donot respond
HIB visa holders make money in dollars that certainly affords them a higher income than would have been possible in their own country. I donot want to undervalue this benefit. But, the American government and citizens hugely profit from the brief stay of these H1Bs in America. H1Bs make money, 99% of which is placed in American banks, which enables banks to fund American projects of citizens and noncitizens. They buy American stock, pay into a social security system and a pension fund that the may not have access to when they themselves are seniors- after all the H1B is only for 6 years. Besides the obvious monetary contributions, they contribute culturally, linguistically and through charity to American society
While they are contributing in as many ways to the American society. Their own lives are in limbo. Continuously stressed over the next rule change in visa status that may affect them, or visiting relatives. Their able spouses unable to work due to visa restrictions. Most of them, live in clean, minimal living comforts as there is always the thought of having liquid cash as one may need to leave the country and then having expensive electronics, cars or furniture may not make any sense. For most of them it does not make sense to own a house on a 6-year work contract.
The opposing argument is that HIB visa holders are subjecting themselves to this lifestyle. After all there are no visible chains around their feet, they are free to return and contribute to the economy of their own countries. But the American dream is an invisible chain currently held by INS merchants as they pull, push or decide to hold steady their white-collar slaves.

    [From the pdf file]

The regulatory definition of "United States employer" requires H-IB employers to have a tax identification number, to employ persons in the United States, and to have an "employer-employee relationship" with the
H-1B "employee." 8 C.F.R. 5 214.2(h)(4)(ii). Accordingly, the term "United States employer" not only requires H-IB employers and employees to have an "employer-employee relationship" as understood by common-law agency doctrine, it imposes additional requirements, thus indicating that the regulations do not indicate an intent to extend the definition beyond "the traditional common law definition." Therefore, in the absence of an intent to impose broader definitions by either Congress or USCIS, the "conventional masterservant relationship as understood by common-law agency doctrine," and the Darden construction test, apply to the terms "employee," "employer-employee relationship," "employed," and "employment" as used in section IOl(a)(l5)(H)(i)(b) of the Act, section 212(n) of the Act, and 8 C.F.R. 214.2(h). That being said, there are instances in the Act where Congress may have intended a broader application of the term "employer" than what is encompassed in the conventional master-servant relationship. See, e.g., section 214(c)(2)(F) of the Act, 8 U.S.C. 5 1184(c)(2)(F) (referring to "unaffiliated employers" supervising and controlling L-1B intracompany transferees having specialized knowledge); section 274A of the Act, 8 U.S.C. 3 1324a (referring to the employment of unauthorized aliens).

My dad came to US in 1971 and got a green card at the airport under "Employment based 3rd preference category(For engineers, Doctors and Chartered Accountantss)" though he went back after a few years. Thats how they used to give Green Cards in those days. Lot of engineers, doctors and chartered accountantss migrated in the beginning of 70s. After few years they stopped that and there was a lot of opposition to Indian professionals (professional rivalry), later stage people found it difficult to survive the rivalry, a lot of doctors went through hell when they found themselves getting fired from residencies and denied jobs. Things are a lot better now as these things are very less heard of these days.

You probably didn't get my point.

I am trying to distinguish between 'offering to cover' vs 'actually have covered'. There could be a lot of difference.

I get your point. I have not used it so far. I figured if need arises and the insurance company refuses to pay then there are legal avenues to claim money from them.

    1) We can go back; need not pretend if we think we have the brains
    2) If you go "your GC misery is over". After that "A new beginning for you and this society"
    3) If you don't go back you don't lose credibility. You just prove that you want to live here no matter what. Eveyone has the right to make his choice based on what works out well for him/her
    4) For those who voted "yes" I think they know what they want in life and why they are here. No matter what the conditions are here or anywhere they will make the right choices instead of expecting someone else to control their lives.

The counter point is "Lobbying is not the only path to our freedom and independence"

Like you mentioned pointing out people and there posts is not required ( if you think that is a smart threat and expect people to backoff) because everyone can search every post of the other person if they want to do so.

FOR ALL THOSE WHO VOTED YES - IF WE HAVE ENOUGH NUMBERS WE CAN CHARTER A A380 OR TWO DREAMLINERS ONE FROM THE EAST COAST AND ONE FROM THE WEST COAST WITH STOPS IN DIFFERENT COUNTRIES TO DROP OFF PEOPLE. IT HELPS US, AIRBUS/BOEING AND THE "NO" SAYERS WAITING FOR THEIR GC'S. THIS WOULD BE FOR SURE A BIG EVENT IN THE HISTORY.

I am not against IV and its goals or against any views or opinions of people. It is a free world, but if we want to pay a price for that we can do so in many ways. e.g. Waiting for GC.

I don't think you will understand this but i will give a simple explanations...

it is not easy for people to pack up and leave when you have family/kids assimilating in the system (forget your "status" for a minute - people living here don't want to move to a different town (forget state) because their kids are in school) <<< this has nothing to do with how brainy you are (in fact it will be stupid to just pack up and leave). Oh and not to forget... i want SS/Medicare when i retire, i paid for it ;)

However I can guarantee you 80% (if not 100%) of IV members with PD < 2004 would have return if they had to restart the process of GC (too late for that we all have 485 applied and AC21 is around the corner ;))

And to answer your question about brain drain... it will happen if immigration is not fixed, if it takes 10-15 years to immigrate then people with naturally opt to get out of here before they are neck deep (like us 7-10 years) in the system.

But really Please Please Please do set an example by going back for good... I already explained the net result of you going back in my previous post ;)

Request: Mods I think this stupid thread does not belong here, please delete it... gjoe can take his agenda some place else to rally some support (perhaps in some anti-immigrant website).
