Did Anybody Successfully DID a H1B Transfer After Entering US on Advance Parole??
I wanted to know the answer for above Question.
I understand that we can do a H1B extension with the same Employer after
using AP.

I have seen so many in this forum spits on L1. This is really bad, we all belong to one family and one kind.
If some one thinks L1 is more advantagous why don't those people join TCS or some thing...
Well let me put some of the Disadv.
1. On L1 one canot change the job. If you want to change the employer you should have H1B
2. L1B salaries are 20% less than H1B on AVG
3. If employer want to send you back (For any silly stupid reason) you are gone
4. Most of the companies like TCS, INFOSYS, WIPRO won't file green cards for 99.99% people
5. On avg a L1 person stays in US in a trip for 1 - 2 years.
Now think!
And above all as I said all those L1 are living in this country legally like me and you, living a painful uncertain life. Because the time is bad now we can't blame them.
Some one talking about getting laid off with TCS employee. just recapture the 5 or 8 years back when you replaced a AMERICAN CITIZEN and you can't call people as idiots ... its street clear.
Well some of you may not agree with me, but if you want to respond harhly just visit any L1B guys house some how they are living.

I am a July filer and was issued a RFE recently. The last update on my case happened a week after USCIS received my reply. I have not been notified for any fingerprinting.

I am certainly not the type to participate in rallies. But I like your thinking and your stand on your points, which I think are not as well expressed as you possibly could.
The only way US Govt is going to worry about solving our problem is if they find it a problem for themselves. And they will find it a problem only when people like you and me start leaving USA in hoards!!
For NOW, the only reason I have applied GC is for EAD for my wife. She is on H1 but doesn't like to work in IT field anymore. Without EAD it's difficult for her to pursue other full-time/part-time careers like fashion designer/teacher etc.,
I have come across at least one-colleague in every client place who left U.S.A - after being here for more than 7 years. And they do have children, houses and handsome salaries. And I know of number of people who have plans to eventually go back. But it's just matter of time and money. If property prices were not crazy in India, I am sure more people would have left by now.
As far as competition with young and talented Indians - I think we are good enough to come this far and should be good enough to compete when we go back :D
The day will come when I will proudly say bye-bye to America and go back to Hyderabad or Bangalore and be happy with better family-life and okay-material life. And guess what, I get to work around the world not just U.S.A.

Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.
Thats cool. I'm sure no one wanted to attack this member directly, but there is a reason why people jumped on the 3 year degree, especially since this is commerce, for a technology job.
I have worked with europeans with 3 year degrees. Many Russians love the BSc physics
3 year degrees are popular and the first choice in many ROW countries (only). I'll leave it at that.
But I have been involved in hiring for quite a few of the top 10 companies in India, and I do know what qualifications they look for and ones they don't look at.

Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?
Q.2) Q.1 raises Q.2. When the dates are no more current, is adding your spouse as a dependent on your 485 safe enuf for her to be considered for filing 485 and getting GC when the dates will be current in future.

Since there are ton of cases, one will not get FP in traditional 30 day but they will get it around 60-90 days (assumption based on ,immigration and immigrationvoice forums and comparing influx with 1999-2000 dates becoming current situation. Yes, i have taken into assumtion that there were 195K h1's that time )
Ok so it's september already and you got your FP! But you want to have a total period of 1 year without losing your pd or your file in queue.
If dates are current in August then rescheduling september FP will go to December/November at the best!
Then you complete the fp process and the average time is 8 months - considering the flood of applications and dates will definately hit retrogressing in Nov-dec, They will assign cut-off dates. lets assume they go back to where the dates were in May/June 07 , then ,you will need to see where you are in the queue. There are some creative ways of generating an RFE (without getting 485 rehected due to initial evidence)- but it's not recommended ;-).

Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

I would strongly suggest everyone to acquaint himself/herself with the legislative process and how a bill moves through different phases / steps before it becomes a law. You can find many postings documenting the process.
Right now it is just introduced in the senate. The problem for us is that Sen Durbin is Democratic Whip (i.e. Assistant Majority Leader) which gives him tremendous influence over garnering votes and referring which legislation to consider to the Majority Leader (Harry Reid in the Senate). Ultimately Reid decides which legislation get priority consideration. The fact that Grassley is a Republican and is close to the Minority Leader (I think) does not help us either. We will monitor the progress of the bill.

Can't we turn Mr Durbin to our side since IL has a large Indian community ?

I have been watching Lou Dobbs on CNN for a while and I am appalled by Mr Dobbs' hatred towards immigrants. He seems to twist or omit facts to suit his line of thought and at times states his opinion as absolute facts (most of which can be easily dis-proven by a 10 minute search on USCIS or dept of home land security websites). My friends and I are considering boycotting CNN if this sort of offensive programming goes on unchecked.

another nice topic to debate....i know that i debated with people about this a while ago and they made good arguments why setting immigration limits/controls by country origin is not discrimination.
Besides the limit is the same for all countries so very difficult to argue for discrimination
It is about individuals, not nations.
I am from India, and I am waiting for someone from other countries who does not even exist. And someone who does not exist (as yet) has a place reserved for him ahead of me, just because he is from that country
Maybe there is a better way of putting this.. no inspiration right now :)

If you can porting to EB2 is always a better choice.
For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.
HR 5882 is the only solution for all atleast for this year.
