As I said in the preface of the list, the bigger objective here is to take certain steps, including proper documentation (e.g. points 2, 3, 4 and 5), in order to maintain PR status. Besides, you never know what documents you would be asked to produce, given that the citizenship process involves more extensive background checks than the GC process. Also, having a log of exit/entry details (point #5) should help quickly fill out Part 7 of the citizenship form (http://www.uscis.gov/files/form/N-400.pdf).

I just called all the numbers and left messages. Wouldn't it be more impactful if we have someone like Vinod Khosla represent us. These calls are great but someone who can walk directly into the Congresswoman/Congressman office will give us greater mileage in our efforts.

On USCIS website I-130 is also pending along with I-485.
At I-485 interview IO said only thing keeping my freedom (GC) away from me is NC.
Does that mean I-130 is going to clear automatically once the NC is cleared ? or do I have to be worried about that separately?

I called the local senator's office (Maryland) and they couldn't give me a response. They claim that they don't have access to the information on a bill status if it is a federal bill. But if I call the representatives from California, the office asked me to call my local representative for information on bill status!
The only house bill with a Senate version is HR 6039 (26 co sponsors). However the corresponding senate version S.3084 only has 2 co sponsors.

Since Visa numbers trickle down, the more visa numbers there are available, the more will trickle down to countries with high demand... recapturing visa numbers might be easier than taking a poke at per country limit.. IMHO...
Recapturing lost numbers is not a permanent solution. Per country limit 7% is ridiculous. We need to make sure we are not discriminated against by the per country limit. Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

One solution might be to make access available only to people with complete profiles.
For instance, verify that all profile fields are filled in, and send an email. If the user replies to the email then the profile is "activated". Or, alternatively, send email with some sort of activation link.
This should eliminate most if not all "ghost" members.

thanks for explaining. my suggestion then is to go to school on F1 (maybe ?) and get a degree that can help him/her get a job that qualifies under H1b.

Those who are celebrating .. consider this.. your employer decides for any reason to not continue filing I-140 or decides to let you go in 6th yr.. earlier you used to have at least possibility of sub labor.. now you are basically straight out of luck.. Also if microsoft needed some genius from China or India to join their team and the guy obviously deserves special consideration due to business need and/or his talent.. they are stuck..! It's not good.. yes desi folks were selling and buying these but remedy is worse than the defect.. they could have made changes to rules to make it stringent and almost impossible to get but no reason to place such arbitraty deadlines etc.. if H1B and GC is geared towards desi consulting.. it's should not and will not exist in the long run..

Are they doing something ethical? NO
So, the law has to change to give everyone a fair chance.

The only problem may be in finding a school district willing to file H1 WELL in advance and accepting the fact that she cannot start working on SEP 1st (when the new school year starts) but OCT 1st.
School is non-profit organization that is exempt from H1B quota. Correct me if I am wrong.

service cntr lady said that they sent the applications back. They do not use overnight Fedex like you and me,they use regular mail.and it could take 4 wks too ..so will have to wait again for this? rejection and then refiling the same stuff?
She just said that to get rid of you over the phone. Lot of people have called USCIS and no one heard of any rejection notice being generated. I think we should be okay!

I assume you've likely never studied in India though. An bachelor's degree in engineering is not very expensive, if you have good grades.
10 years back it would cost about $100-200 a year, if you qualified through a state ranking system.
Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.

When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.
My 2 cents�
These types of employment advertisements are discriminatory and are thus illegal unless it is work that requires security clearance. I am surprised that the Department of Justice is going after employers (http://www.immigration.com/newsletter1/doj_investigation.html) who may have advertised jobs for non citizens while not going after the numerous advertisements that discriminate against non US citizens. I am aware of atleast one high profile company that engages in this type of activity in its advertisements (however one needs to apply and be rejected in order to file a complaint). The double standard is indeed disturbing :
