If restraints are necessary in any manner under such conditions, they should be the least restrictive type possible to remain consistent with sound security practices.
So the warden can still order restraints.

I was out of status when my parents couldn't act fast enough to change my status. However, I faithfully maintained my status once I reentered with a student visa.
So here is the history:

While what you say is from a very neutral perspective as you see things from the other side of the wall, it may not be 100% true in what you think it is. These agencies or companies are a creation of the system, tons of people come from India to fill job positions and systems have been designed to accommodate that. Companies like Wipro, Infosys, etc... have HR people stamp their own H1b visa and send people in a bunch to the consulate for verification.
Indian companies do not 'FAVOUR" Indian workers, but take advantage and try to "EXPLOIT" Indian workers to cater to businesses.
The way the system works is, there is always available pool of talent for American businessess, these happen with rules being framed to accmomdate skilled workers.
Just like how Jewish people good in Financial stuff, Indians have been immigrating in skilled worker category.
While from your perspective you seem to think that it is some sort of Mafia trying to break rules and taking law in its own hands, favouring thier countrymen, it is because you don't have such a big infrastructure in China or Philippines etc... it is again the same Indian companies that are opening up branches in Singapore, Malaysia, Shangai, etc.. and reqruiting people from there too. Chinese consulting companies are now operating in full fledged manner these days and there seem to be companies that cater to Chinese Canadians looking for jobs in USA by providing them a TN visa letter and bringing them to US and place them in Client locations.
I have nothing against the staffing agencies whatsoever. I actually like the business model. The laws are generally being followed. There is nothing wrong with it. However, I do ask many of the companies why they only have indian or south asians. Especially if they have indians coming from Germany or Singapore, etc. Common answer I get is that other people have too much restriction. Expectation would be they would have their own corporate apartment, no bench time; selection of projects and no travel. As you know this is a little difficult to accomodate for these companies.
It generally is being clogged because it is getting around family base immigration. Although there is nothing wrong with that legally; it does hurt the people who cannot have the same accomodation. I know many, many people who have u.s. citizen brother; sponsors parents for greencards, rest of siblings come through staffing agency and then cousins get invited through h-1b and then spouse want to work and then another h-1b gets used. Eventully whole extended family base is here going through employment base when perhaps they should be going through family base. Other country people do not have such luxuries or companies looking to sponsor them specifically. Other country people generally went to school here and then went to h-1b and even then they have a difficult time getting it because they don't have the connection.
Because of all these workarounds; it is going to cause a lot of people to be here from just certain countries. I firmly believe that lawmakers, uscis know this pretty well (i've actually seen it in an i-140 denial where brother was ceo and sponsoring his brother for greencard) and this is why they don't want to lift country caps. 1. documented / undocumented is a matter of immigration status..... no human can be illegal..... an activity can be illegal which makes a person undocumented...... as defined by human law...... but above human law there is another law..... which is defined by an entity more or less we all believe in..... how can a new born child.... a creation of the creator be illegal? delivery of a child is not just a matter of mother.... its a matter of another life being brought into this world..... how can that child be illegal?
2. even felons are not shackled to bed.... unless someone is danger to others..... how can a pregnant woman just about to deliver a child be danger to anyone else.....
3. i lost my wallet few days back.... anyone could lose their wallet sometime or the other ..... it happens..... and during that time we are all driving with a license..... does it mean we all must be shackled to bed when delivering a child......
4. unpaid driving fines?? big deal.... obama had unpaid tickets.... which were paid just before announcing presidential nomination.... majority of the people voted him to become the president..... but according to you..... its ok to shackle someone when delivering a child if that person had unpaid tickets..... nice....

As per this $20 drive, I tried to contribute thru my Visa Card & it was "repeatedly" prompting card# enter is invalid...I checked/ensured expire date/secure code & info which I entered is correct but repeatedlly it was prompting same message...Anybody from IV can help whats wrong with the web page?

Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

But I question your approach and the need for such scathing attacks. Please do some research and see if historically, 'tough love' or hurling insults has motivated people. The answer is a big fat NO.
A leader has to influence people to go from motivation which lies just below the threshold to a desire to cross the threshold to action.
Why do people decide on acertain course of action and how this turns into committment? It is known as Volition.

This is a good idea. But tough to sell unless basic policy is changed. In USA any immigration has limit in numbers except a few category like spouses of US citizens. It is difficult to change that. When you put 8 years that means unlimited green cards. If they do that universities like TVU will be running full capacity and new universities will be started similar to that. Actually there should be some system to clean up univerity admission and also H1B so that genuine persons can come here easily.
Anyhow it is good idea to bring a bill like this and and see what happens. Still bills like recapture or modest rise of GC numbers will have a better chance of passing in congress

there is such a huge backlog for Indians that even the news above won't help much... overflow from family category has slowed down and previous recaptured visas are over ..the news that CIR has been delayed could be good as there is higher chance that there maybe some sort of relief ..other than that the situation is HOPELESS !!!

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

It will take 10 years to see the light (GC) at the end of the tunnel, IV can help you get there faster. How faster you get there depends on your contribution?

I think with in this short time duration, i am going to proceed as such with my wife's name problem, and once the 485 has been filed, will go ahead and try to get a name change done for the passport from the indian embassy. I was told by one of the members on the forums, that you need the following things:-
1. Advertisement in a National Indian News Paper.
2. Advertisement in a USA Local News Paper.
3. An affidavit from you, but if you are married and have the original marriage certificate, then it should take care of the affidavit.
I think the costs to get it done is $70. If some one can suggest some other options that will be great.
