I think we should also hear from people who have taken action and what their experience was. This may give ideas to others.
I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.
If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.

I suggest that you remove the glass house proverb. It makes the letter look a little unprofessional. Your letter without it is already very effective. Also put the "H1-B workers are illegal" quote (if there was such statement made on his show) at the top while you put across your objection. If such statement wasn't made but implied by the guest on CNN, don't put that in quotes.

You have to see my quote from the context of immigration. I never said illegal immigrants do not have any rights. Human rights are across the board. Every nation must follow these standards. Illegal immigrants can not sneak into a country and then demand that they should be given citizenship.
Regarding undocumented workers filing with EEOC, please quote me few cases like that. I doubt if it is ever possible. In my personal opinion, when such workers are subject to deportation when found, where is the foundation in that case? Are you suggesting that non-citizens can apply for jobs in defence and aviation and complain to EEOC if rejected?
Again this could be looked at from many angles. The right to march and demand citizenship is protected under the 1st ammendment. Whether they get the citizenship or not is another issue but indeed yes, as ridiculous as it is, one is free to have the audacity to make statements that may be ridiculous in nature and that is their right under the 1st ammendment to do so as long as they are within the borders of the US. It is these types of freedoms that distinguish America from many other countries, to the extent to where even a person subject to deportation has the right to due process. The 1st ammendment guarantees the freedom of expression. Indeed a Federal District court has already ruled that immigration status is not a matter that is debatable in a EEOC/discrimination law suit. If the below is not sufficient there are some actual cases involving undocumented workers who were not victims of human trafficking.

If you read my other post correctly, it said the exemption was with security clearance related jobs. The two types of jobs you cited more than likely require security clearance but if they do not then its fair game for a discrimination complaint. Security clearance is only available to US citizens. My point is that if an employer with more than 4 employees whose job offering does not require security clearance or does not touch on matters of national security has a job posting claiming 'US Citizens Only' and an eligible for work non US citizen eg Green Card Holder or H1-B, EAD holder applies and is rejected primarily on the basis of their national origin or immigration status then yes, they do have credible grounds upon which to file an EEOC complaint. Note that an employer is only supposed to ask for documents that identify eligibility to work when they have made the decision to hire and are filing out form I-9. For instance there is already a case where EEOC or the DOJ won a case because an employer insisted on seeing an employee's GC and would not take an EAD. In summary, I'm not suggesting, it is the law and I believe I have given references to the relevant sections in my other post. But if in doubt, you may want to check with a lawyer and not take my word for it since I'm not one.

i'm not sure i understand. but maybe i'm not good enough for "reverse brain drain" and to those who voted "yes", please confirm July 4 that you are leaving. i saw some of you tracking receipts in desperation? why, why for god's sake? if you are ready and willing to leave in 6-8 months did you care so much? wish there was a way to hold each one of you to your words.
and anyway, what are you doing for that "freedom and independence"? how many of you are actively helping in iv's lobbying effort? just sitting around and watching or criticizing is hardly winning any "respect". please don't make me point out individuals and start pasting their previous posts here...

I understand that I'm trying to chose a devil/insurance, which is lesser evil compared to the rest.
So, in that aspect, Comprehensive/Fixed appears to NOT matter at all. These are just pricey nouns. I can't believe that K.V.Rao's insurance lying publicly that it's a not-for-profit. These ridiculous kinds, stoop to such a level of cheating people with a Indian name on it.
I'm still open for any recommendations here. I appreciate all your comments & suggestions so far.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,
>who can�t vote and
>who can�t contribute to his election campaign�
what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess �. And it�s a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!

Honestly, I agree with you...but the underlying fact is some people get motivated for calling the senators and some for anonymous fax/email/flowers and some for rallies. There is definitely a subset who does all...but unless you are a Gandhi/MLK/JFK/Mandela....it's hard to drive people in one route.

The response is expected. Unless IV core members support nothing will move. Many similar threads came and go in past. IV is giving critical updates only to Donor members. So only donor members will know what is happening. Others will not know anything and will not have any direction. That may be one of the reason for poor response for these kinds of polls. If majority of the members are donors then that will be effective.
Count me in as well. This memo is completely discriminatory and will do more harm than good. It is surprising that very few are willing to come forward and fight this abuse. I am sure that there are hundreds of affected members and a collective effort will help us all.

Unfotunately what you are saying sounds cool except that its not true.
Job offer has to be valid on the day petition filed or the specific date mentioned.
If the job offer no longer exist, employer need to withdraw the H1. Until and unless employer does so, he is on hook to pay the employee.
The only argument against employee here is , employee did not report to work. If employee can prove (through email copies etc) that he actually tried to report but employer barred him, employer must pay the wage till the date H1 was sent for withdrawal.
Filing an H1 means that a job offer exist as of the day requested in the petition . For example, if the petition has a start date of Oct 1, 2010, and the petition is not withdrawn, employer is stating that he has a valid job opening starting October 1. No additional job offer/invite is required. The only time such invite *May Be* required (at PoE) is if the employee is travelling much later than the start date specified in the Petition.

Rather than pushing for Bills which will pass only after we get a GC, why don't we ask for something more practical. I mean ask for minor policy changes rather than asking for major law changes.
Like,

2- reducing the timeframe to apply for AC21 from 6 months to 3 months,
This will solve a lot of people's immediate problems.
There are many people who couldn't get their status readjusted due to retrogression after filing I485, but could get EAD atleast.
What does that mean? It means by law only a certain amount of GCs can be issued in any year, but USCIS may issue more EADs based on one of their policies.

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!

I have checked with my company's lawyer and he said I can maintain H1 status with my current employer and use EAD for part time job. I read murthy chat transcripts and same topic was discussed with two different answers. I have read at many websites different and I read mixed responses from different lawyers....point is nobody knows for sure if you can maintain your H1 status while working part time on EAD...
In any case, I will be working part time on EAD and I will inform my HR about my status change from H1 to EAD on my I-9 to be on safe side.
I work for a very big company and I have my LC, I140 and EAD approved. I am hoping for the best that my AOS won't be denied. If my AOS application gets denied then I do not think any other company would be able to get it approved. It is true that I will get some time buffer if I am on H1 and my AOS gets denied but I do not want to be limited by work authorization limitations...
