    McCAIN TOUTS IMMIGRATION REFORM PLAN IN MIAMI: In a Miami rally, Sen. John McCain pushes for reform that would legalize up to 11 million migrants

    Pushing for immigration reform that would legalize as many as 11 million undocumented immigrants, Sen. John McCain was preaching to the converted Thursday night at a packed town hall meeting that at times seemed part stump speech for the Arizona Republican who's eyeing a run for the White House.

    ''Our legislation will be taken up in the United States Senate within the next weeks and you've got to go to work,'' McCain told the more than 1,000 cheering and chanting supporters at a cavernous auditorium at Miami Dade College's Wolfson campus downtown, urging all to garner grass-roots support for the bill he and Sen. Ted Kennedy, D-Mass, have co-sponsored. ``You've got to work not only here in Miami-Dade and around Florida but around the country.''

    The town hall meeting, which had the feel of a campaign rally, brought together disparate groups -- Cuban and Haitian immigrants, business and labor union leaders, Mexican farm workers and South American illegal immigrants -- all united behind the common agenda of helping the McCain-Kennedy bill prevail in the coming congressional debate.

    McCain's Miami visit, which included get-togethers with Cuban-American business leaders and young immigrant students, came on the same day that the Bush administration extended for a year a controversial temporary worker program for 304,000 Central American illegal immigrants living in the United States.

    MOST GENEROUS BILL

    The McCain-Kennedy bill would grant temporary work permits to illegal immigrants and then after waiting six years and paying a $2,000 fine, it would enable them to apply for green cards.

    It is the most generous of the bills now before Congress. A bill passed by the House in December seeks to criminalize illegal immigrants, impose stiff penalties on employers who hire illegal immigrants and target for prosecution anyone, even religious or advocacy groups, if they help undocumented migrants.

    SALVADORAN AID

    Salvadoran President Elias Antonio Saca, meanwhile, teamed up with South Florida's three Cuban-American U.S. representatives in Miami Thursday to thank President Bush for ordering the continuation of TPS.

    Emilio Gonzalez, the head of U.S. Citizenship and Immigration Services, told The Miami Herald that TPS extension reflected an administration policy to "help our neighbors and do the right thing in their time of need."

    The Miami Herald reported last month that Homeland Security officials were debating ending TPS for Central Americans. That spread alarm in the immigrant community, triggering intense lobbying of the White House by Miami's Cuban- American representatives and Central American community leaders.

    Gonzalez said the program was extended for a year instead of the regular 18 months because that was the ''consensus'' decision.

    Saca said that when he meets with Bush in Washington today he will also urge the president to push for broader immigration reform.

    Reps. Ileana Ros-Lehtinen, Lincoln Diaz-Balart and his brother Mario Diaz-Balart gave Saca credit for helping to keep the program alive by lobbying hard on the issue.

    ''He is the hero of the moment,'' said Lincoln Diaz-Balart.

    Critics of the TPS program believe it has become an entitlement for certain illegal migrants -- while proponents argue it represents income and stability for poor Central American countries.

    The extension covers about 225,000 Salvadorans, 75,000 Hondurans and 4,000 Nicaraguans. Extensions will expire Sept. 9, 2007, for Salvadorans and July 5, 2007, for Hondurans and Nicaraguans.

    Among the TPS immigrants attending the Saca press conference was Yesi Gonz�lez, 23, of Honduras, who grew up in Miami since she was 7 years old. She now works at Padr�n Cigars.

    ''I'm very happy because I was very worried that I would have to leave my job, and maybe the country,'' she commented.

    Received that standard email, today, about status change to "RFE Sent" for both my wife (dependant) and me.

    Will post again when I find out what it is...
    Employment Verification?
    Married for just a couple of months prior to 485 application?
    Photographs?

    It is beginning to look like there is some sort of pattern here - the "older" cases (2003 through 2005) are being issued RFEs, regardless of category. Is this what they meant by "pre-adjudicating" cases with non-current PDs?

    Hi Gurus,

    I need an advice from you.

    The situation:
    -- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)

    -- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.

    So what are my options now?

    1. Check with attorney and start defending..?
    2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
    3. What about my GC?

    Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

    Sorry to hear about your case. Trust me, such liability suits are extremely common these days in America, and there is no cause for alarm as long as you take all the necessary steps.

    If you had liability insurance for your auto at the time of the accident, the first thing you have to do is to call that insurance company and let them know about the lawsuit. THEY will hire and pay for a lawyer to defend you. If you want to be even more comfortable, you might also hire another defense attorney by yourself.

    The catch is, your insurance lawyer will only defend you upto the amount of liability mentioned in your insurance. If there is any judgement over that amount, your personal assets are at stake. This happens only in very very rare scenarios. Most of the times, such lawsuits are settled out-of-court. The amount mentioned in the lawsuit ($3.25 M) is totally irrelevant- what they would eventually get (if any), will be far far away from this figure.

    Assuming that there are no criminal charges, and this is a civil tort case, there will be no impact on your immigration proceedings at all.

    Make sure you take all the paperwork very seriously and do not ignore any letter/notice/deadlines. Don't even think of running away- its not worth losing your career you have worked so hard for. Unless yours is an extremely unusual case, all that you stand to lose is several nights of sleep and thats all.

    The whole movement against retrogression started only when things went beyond reach.
    Yes, we believed in a process and planned accordingly but as we get going we suddenly see that the goal post is not visible anymore, it has been removed and moved far putting us all into a limbo state.
    It is definitely our right and not a previlige. When we do not see a goal post and don't know where we are heading we do have right to ask "why and what is the solution".

    Though we are not citizens we do have the right to seek a fair system.

    Nobody is complaining because everybody has the attitude, "Let somebody else do it, I will reap the benefits".

    With due respects, dude, this is one thing an individual should fight for himself, how will some other employee benefit if you sue your employer and win?..

    The employers are happier to hire illegals as they can pay them shit wages, they don't have to pay er's contribution of social security wages, no er's contribution of state taxes, no Medicare tax, no workers compensation. Just imagine wont we be annoyed if we can't find a job in India because Nepali or Bangladeshi (no disrespect to these countries) illegal migrants are talking our jobs away from us by working for lower wages.

    I do not think small time bad desi employers are hiring illegals. They are doing everything right as per law, it is just that the law is in favor of the employers and the immigration delays further gives them leeway to try their dirty tricks.

    Having said that, I appreciate your post informing affected employees on how to file a case. It will be useful for people who have a case against their employers. Please keep us posted on the outcome, I am sure it will motivate a lot of us.

    I understand your frustration. Believe me I have gone thru the same.

    When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.

    One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.

    I know, the wait time is long, but it is worth it every bit.

    Hmmm so you have been a victim of random processing too? The situation is a mess no doubt. But this random processing really hits where it hurts the most...

    IF ONLY everyone who gets a GC approval or citizenship could work at the CIS for a year... a sort of community service.... All of the problems wrt the random processing will go away...

    I am sure most people on this board can hit the ground running and don't require extensive training... unlike the present day IOs.

    Some of us are in Eb3 because of our experience, some of us are in EB3 because of circumstances (I had 7 years exp when my GC was files, but 3 years out of it was spent as consultant in my current employer place. Hence we could use only 4 years as exp and hence EB3), some of us are in EB3 because of lazy lawyers.

    We cannot blame EB2 or any other category for thinking for themselves. That is just human nature. I have done everything to support IV and will continue to do so, be it letters, faxes, calls or money. But I also know that no one is going to fight for Eb3-I. Once my EB2 friends get their GC, there may be no IV remaining. That is OK with me. I will still contribute.

    All I want from EB2 people is to stop making fun of EB3 cracking jokes about losers, etc. You never know when destiny takes a U-turn. It may as well happen that all EB3-I get their GC and the joke crackers never get it. So please, EB2 should enjoy their forward movement of dates. But please do not make fun of EB3-I.

    I sent #7001 form in second week of October , i emailed CIS Ombudsman3-4 days back . I received this email today....

    Thank you for contacting

    October 21, 2009. Your case is in the process of being assigned to an
    Immigration Law Analyst. Please allow us 14 working days to process your case

    Any updates?
    I checked my former approved H1Bs and found:
    1) The Sept. 2000 approved H1B with LUD of June 2007
    2) The Feb.2003 approved H1B with LUD 0f April 2006

    For both cases, it seems the status is the same as when it was approved in Sept. 2000 and Feb. 2003, nothing new. Maybe these are automatic updates by the computer system.

    Here we go again.
    Jees, stop posting this over and over man.

    Why not, we need all of you to be active state chapter members. If you are then this is not for you, but if you haven't already, then join and make a difference. We can have interesting discussions and there is absolutely no problem with it, but we also want members to further IV goals. As the model followed is an all volunteer model, all of us know, volunteering does not come as given for everyone. Some need to be inspired, so need to be pushed, if we did not have people who did this, IV would not be existent. Try to understand why people ask everyone to join state chapters. I will stop lecturing now, but yes, threads need to be hijacked to get the point across. Without grass roots organization we will not make any progress and will defeat the whole purpose of having an organization being build from the ground up.
    Thanks and appreciate your understanding. We want everyone to be involved, we must be able to use all means to get the point across which could mean making a point in different threads too.
