i called a couple of times spoke to Inf officer at NSC ,
&& she told she was not aware of cases where NSC has created rejection letters and sent them also she added they just completed june filers and will be starting to proceed with JULY .
Now reg. my processing times:

Receipt Jul 2 9:54 : FedEx
status : On Hold ?
Checks : Not cashed Yet
She also adviced most probably i should receive some kind of communication before end of july !!

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

I sent #7001 form in second week of October , i emailed CIS Ombudsman3-4 days back . I received this email today....

On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues
Description for denial ( I have also attached the denial notice)->
They looked at years 2003 to 2006 history for I140 since PD is JAN 03.
* Reason 1 - Lower salary than specified in labor
Preferred Wage in labor - 78,750
W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.
* Reason 2 - negative net income of the petitioner
2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);
* Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
and my lawyer did not provide 2006 information
Acceptable Assets Aceptable Liabilities Net Current Assets
2003 $4,272,733 $3,789,359 $483,374
2004 $4,871,615 $4,660,879 $210,736
2005 $5,047,775 $6,494,111 ($1,446,336)

Your application was denied not with a combination of
Reason 1 , 2 & 3, but each reason by itself was insufficient to prove ability to pay. Your employer should meet atleast one of these to prove "Ability to Pay".
It's deplorable that most attorney's don't educate small employers on meeting ability to pay even before filing the Labor Certification.
I would suggest that you appeal the case with supporting statements from a good CPA and in the meantime go for a fresh labor certification.

Many folks suggest that this BIll (when turns into a law) would promote outsourcing..but how does these set of changes being proposed by Odama's admin. would affect outsourcing??

I know it wont "stop" outsourcing in any way but seems like they claim that they are " taking away the tax advantages of companies shipping jobs overseas"...Iam sure its more complicated than that..
However the kind of tone being set by the incumbent these days, I believe reflects the current administrations policies that might trickle to us(documented workers) as well.. not sure..
However this can be also looked at, the adminstartion si trying to "show" that they are doing whatever they can disccourage companies from sending jobs overseas..and then eventually take a stab at CIR..wishful thinking..:D

I think there is another issue here. lets say you file for your 485 and you get married later in teh year..by that if PD retregresses again, your spouse wont be able to file for 485, since she gets your PD. so you might get approved sometime next year and you will loose your h1b status, then it gets to be a problem for the spouse since she is still waiting for PD to retrogress..so please talk to a lawyer and get all the facts...

For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.
I had the SAME exact problem, both, with people here (indian citizens who are now american citizens) and people back home. To the point where, once i was addressing a group of my community members and a couple of Indian american people absolutely REFUSED to belive that the Govt wud give illegals a better break than they wud give us, and that it had happened in the past. It took me half an hour and quite a few examples to illustrate how that was true.

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

Cool down. Remember we are foreigners in this country. We need this country more than they need us ( as they say, graveyards are full of indispensable people!). A country is not considered advanced by the cell phone models people use, but rather than how much food they produce, what is the standard of living, how many noble laureates it produces per year, etc.
Besides, in my 7-8 years living in this country, first as a student and then as H1 worker, never once have I felt being treated differently because I am a foreigner or look different.
Now compare that to living in Europe (you will be treated as dirt as soon as you enter airport), it is racist, living in past and full of bureaucracy.
As for India, mera bharat mahan, but I remember a time when I had to pay bribe on the train ticket counter to get a measly 2nd class sleeper ticket, or just to get a electric connection, would dare not get near a policeman, etc. etc.. The list is long and I suppose I everyone here knows what I am talking about.
So please ask for your rights but remember you are in their country, nobody forced you to come here, and beggars can't be choosers.

A joke, right? Financially maybe, technologically never. Most European countries are far more technologically advanced than US. I'm sure Japan, Hong Kong, Singapore also are all more advanced than US.
For example, only US is still using paper checks to transfer money. Using coins to pay for a phone call in phone booth. Still has no control over who lives in the country, or who goes in and out. Still not using computers for processing immigration applications (Why do I have to send in the same papers 10 times, send in tax papers, give my background info, give fingerprint 10 times.... and this all on paper... come on it is 2007 not 1907). Still drive around in cars instead of having a good inter-city connectivity with trains. No high speed trains. Still likes to see rubber stamps on official papers and believes it has any kind of value.
And so on and on and on.... I could write a book why US is behind most civilized countries. But thats ok. US is what it is.
But the worrying part is; it is going to get even worse when they kick out all the H1B etc who are here legally and provide free knowledge. And instead keeping the uneducated mass of Mexicans or south americans who run across the border illegally and then given amnesty by some fool in Congress. Good luck with that project.

Then there is no need to worry. FBi check is valid only for a certain period so that is the reason why they would have ordered for other check. Don't Worry you will get your greencard. But when your PD is current open a service request. i did mine when my Pd is current and got my Green card.

I am settng up tea stall at Asian Festival(just for fun) , i will give all my profit to IV. Approx. 20,000 people visit the festival so i should be able to make atleast $200-300 profit with my tea stall.
