Please remember that ICICI gives LIMITED coverage for anyone above the age of 56. It is mentioned in the "fine print". They have a restriction of say $1200 per day of hospitalization (not sure of the exact amount- but somewhere in that region).

It sounds like Comprehensive Insurance from a US company might provide the best "insurance"

I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

IV managed to fight its way through the July visa bulleting fiasco and compelled the USCIS to honor the original bulletin. Lou Dobbs was in Orange County this weekend as a Keynote speaker at the The World Affairs Council of Orange County. He launched into his usual vitriolic diatribe, there were many business leaders at the forum and he ended up polarizing the crowd. Some felt that he is all talk with no practical real life experience managing companies, his ideas are over the top and cannot be implemented. He never ran or lead a fortune 500 company or held a major political office, yet he critiqued the very organizations who sponsored tables for this dinner. A few did get carried away by his speech, i have to say that the crowd at the back was cheering wildly for him while the executives in the front were subduded. BTW this person with socialist leanings has hefty appearance fees.

It is widely known fact that Members may be even reluctant to answer the same question again and again ... but unless a legislation is passed , PD will not move.
Fact is many of us are in a bad state for the options we have selected in our lives.
There is an organization like IV which is trying to help all of us. Infact IV members consist of people whose priority dates have been retrogressed for a long long time.
Also past 2 years (yes 2 years !!), some bills have been passed in only in Senate and hence fully did not become a law.
Hopefully something will happen and give us relief. My advise , don't forget to help IV where you can.

USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

Filed to TSC in January 2008 and I just got the RFE from TSC for my EB1-OR
petition:
It says:
"On the I-140 submitted, you failed to complete th form as requested. On
Part 5. Additional information about the petitioner. You did not complete #2
. in reference to the Gross Annual Income or Net Annual Income. For
companies of 100 or less employees, the petitioner must submit the last two
recent quarterly reports which lists employees; wages and social security
numbers as evidence to ability to pay proffered wages.

140 form part 5, #2 I put "0.00" for both Gross Annual Income and net Annual
Income according to the information I got from my employer.
The lawyer I hired filed my I-140 (I got signature from my employer) WITHOUT
my W-2 form or my last year pay-stubs. In stead, he attached my W-2 form
and three month pay-stubs with my I-485 application.
Now my employer refuses to give me those financial statements listed in the
RFE letter, what should I do?????

May be US corporations can tactically support this bill because this bill will impact Indian bodyshoppers severly. For past 5 years US companies could not compete with Indian companies as they have more leverage on H1b. Now if Indian companies avoid H1b US companies can get any time they want as they can satisfy most of conditions

DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.
